11.06.2008 The Committee on Judicial Policy recommends that the Parliament adopts as a Basis several Bills that secure Observance of Rights of the Children deprived of Parental Care

The Committee members scrutinized three Bills, namely: "On Amendments and Supplements to the Family and Criminal Codes of Ukraine" (re Adoption) (Reg. No. 2046), "On Amendments to several Legislative Acts of Ukraine regarding International Adoption" (Reg. No. 2116-1), "On Amendments to several Laws of Ukraine (re Provision of Rights of the Children under Custody (Care) (Reg. No. 2122).

Thus, the Bill (Reg. No.2046) amends the Family Code of Ukraine, and extends the range of persons who can not become adoptive parents.

Due to the request of a governmental body in charge of adoption and protection of children´s rights, the Ministry of Internal Affairs is to check the foreigners willing to adopt a child of a Ukrainian citizen, on discreditable information about them in the foreign law enforcement bodies and the General Secretariat of the Interpol.

The Bill (Reg. No.2116-1) specifies the regulations of the Family Code of Ukraine as regards prohibition of commercial intermediation activities concerning adoption of children. The Bill also specifies the procedure of authorizing foreign organizations to conduct activities concerning adoption at the territory of Ukraine.

The Bill envisages that parental consent on adoption of a newly-born child becomes effective only when the child is two months of age.

The Bill (Reg. No.2122) introduces amendments to the Civil Code of Ukraine and the Law "On State Aid to the Families with Children".  It secures right of the children deprived of parental care for all types of target aid (one-time, on custody over children; for children under custody or care).

The Bill (Reg. No. 2531), submitted by the Cabinet of Ministers of Ukraine, raises the lower limit of sanctions envisaged by Articles 204, 205, 206, 206-1 of the Code of Ukraine on Administrative Infringements, and slightly raises the upper limit of liability for violations envisaged by the said articles of the Code.

Thus, infringements envisaged by Article 204 (violation of procedures of employment, enrolment for studies, rendering of housing, registration or ending the registration of foreigners and stateless persons), entails a fine in the amount of 100-200 non-taxable living wages of the citizens (sum total 1700-3400 Hryvnias).

The Committee members upheld the Bill, since its adoption will enhance prevention of infringements in the migration sector.
